Kagoro, a Zimbabwean lawyer affiliated with the Open Society Foundations, first landed at Jomo Kenyatta International Airport and never made it past the gate. National intelligence officers held him for more than ten hours, questioned him about alleged links to protest financing and organisation, then slapped him with a removal order directing the airline to fly him back to Johannesburg. No formal charges. No written explanation. Just gone.<\/p>\n<\/p>\n
Open Society Foundations hit back immediately and without ambiguity. The organisation categorically denied that it funds or organises political protests, and stated plainly that no evidence had ever been presented to substantiate claims that Kagoro financed or coordinated political unrest in Kenya. Kagoro himself has never been charged with, let alone convicted of, any criminal offence. The Kenyan government offered nothing to counter that.<\/p>\n<\/p>\n
Kagoro didn’t accept the deportation quietly. He went to court. He won. A Kenyan court issued orders allowing his re-entry into the country, and last Tuesday he boarded a Nairobi-bound flight from Johannesburg. He never arrived. Kenyan authorities had him pulled off the plane in Ethiopia before it ever touched down at JKIA.<\/p>\n<\/p>\n
Read that again. A man with a valid court order permitting his entry into Kenya was physically removed from a flight in a third country. The state didn’t challenge the court order in court \u2014 it simply ignored it. Open Society called it exactly what it is: a direct disregard of a judicial ruling, and a fundamental assault on transparency and due process.<\/p>\n<\/p>\n
The High Court responded by granting Attorney General Dorcas Oduor fourteen days to explain why Kagoro was blocked for a second time despite the existing court orders. Fourteen days to explain the inexplicable. The clock is ticking, and Kenyans \u2014 especially young Kenyans who took to the streets demanding accountability \u2014 are watching.<\/p>\n<\/p>\n
If you think Kagoro’s story is a one-off bureaucratic mishap, think again. On July 5, 2025, Martin Mavenjina, a senior legal adviser at the Kenya Human Rights Commission, was deported from Kenya under circumstances that the commission directly linked to the shrinking of civic space and the targeting of human rights defenders. Two senior human rights figures, deported within months of each other, with no credible official explanation for either case.<\/p>\n<\/p>\n
Civil society organisations are not speaking about these incidents in isolation. They are connecting the dots \u2014 and the picture they’re drawing is of a state that has grown deeply hostile to independent human rights work, particularly in the aftermath of the Gen Z protests that shook the Ruto administration to its core in 2024. The protests embarrassed the government. The crackdown that followed was brutal. And now, it appears, the government is going after the infrastructure of dissent itself \u2014 the lawyers, the advisers, the international foundations that support civic organising.<\/p>\n<\/p>\n
This is not just a story about one Zimbabwean lawyer or one Kenyan human rights adviser. This is about whether Kenya remains a country where courts mean something, where human rights defenders can operate freely, and where the government cannot simply disappear inconvenient people by rerouting their flights. If the state can ignore a court order this brazenly, it can ignore the next one. And the one after that.<\/p>\n<\/p>\n
Kenya has long positioned itself as a regional anchor for civil society, a hub for international NGOs and human rights organisations across East Africa. That reputation is being dismantled, case by case, deportation by deportation. The question is no longer whether Kenya’s civic space is under threat. It clearly is. The question is what happens when the Attorney General stands before the High Court and has to explain herself \u2014 and whether that court will hold the line or fold under pressure.<\/p>\n<\/p>\n
