The hearing is set for October 6, 2026. This is not a drill.<\/p>\n<\/p>\n<p>This case lands in the middle of one of the most embarrassing weeks in Kenyan football history. Harambee Stars players went on strike ahead of a 2027 Africa Cup of Nations qualifier over unpaid allowances. Head coach Benni McCarthy admitted publicly that he has been working in Kenya for over a year without a valid work permit. And when the Sports Ministry finally moved to address the players&#8217; grievances, the players said the amount disbursed was not what they were promised. One ordinary fan looked at all of that and decided someone had to act.<\/p>\n<\/p>\n<h2>What exactly is Ngula asking the tribunal to do?<\/h2>\n<\/p>\n<p>Ngula&#8217;s statement of claim is direct and surgical. He wants the Sports Disputes Tribunal to order FKF and the Ministry of Sports to produce a verified schedule of all outstanding allowances owed to Harambee Stars players and technical staff, complete with a concrete timetable for settling those debts. He is not asking for vague promises or press statements \u2014 he wants a documented, court-supervised payment plan.<\/p>\n<\/p>\n<p>Beyond the money, Ngula is demanding transparency. He wants both institutions compelled to share that financial information directly with the players and technical bench, so that the people who actually wore the jersey and stood on the touchline know exactly what they are owed and when they will receive it. That demand alone is a damning indictment of how opaque football administration in this country has become.<\/p>\n<\/p>\n<p>The third and perhaps most explosive prayer concerns Benni McCarthy and the rest of the foreign technical staff. Ngula wants the tribunal to order FKF and the Ministry to take all necessary steps to secure valid work permits, passes and lawful work authorisation for every foreign personnel deployed in service of Harambee Stars. McCarthy&#8217;s admission that he lacked a work permit after more than a year in the role is not just an administrative embarrassment \u2014 it is a legal vulnerability that exposes the entire national team programme.<\/p>\n<\/p>\n<h2>Who is actually being held accountable here?<\/h2>\n<\/p>\n<p>The tribunal has given FKF and the Ministry of Sports until noon on October 2, 2026 to file their responses. The hearing itself will be conducted via Microsoft Teams on October 6, chaired by Luke Wamugunda, with Allan Mola and Victor Omwebu as panel members. Ngula retains the right to file a further affidavit after reviewing the respondents&#8217; submissions.<\/p>\n<\/p>\n<p>What makes this case remarkable is who filed it. Not a player. Not a union. Not a politician grandstanding for cameras. A fan. Someone who pays attention, who cares enough about Kenyan football to navigate legal processes that most people find intimidating, and who clearly trusts the Sports Disputes Tribunal more than he trusts FKF or the Ministry to sort this out voluntarily. That says everything about the state of institutional accountability in Kenyan sport.<\/p>\n<\/p>\n<h2>Why does this matter beyond football?<\/h2>\n<\/p>\n<p>The Harambee Stars crisis is not really about football. It is about a pattern in which public institutions collect resources, make promises, and then treat the people who delivered on their end of the bargain as an afterthought. Players trained, qualified, and represented this country. McCarthy showed up to coach, work permit or not. The Ministry and FKF collected their budgets, held their press conferences, and apparently failed to manage the basics.<\/p>\n<\/p>\n<p>Young Kenyans watching this unfold understand exactly what is happening because they have seen this script before \u2014 in hospitals, in universities, in county governments. The powerful delay, deflect and disburse only when cornered. Brian Ngula just cornered them.
